OrderWayz Terms of Use

1. Scope and Definitions

These Terms of Use ("Terms") govern your access to and use of the OrderWayz platform. OrderWayz is a web-based ordering system that facilitates transactions between Users and Vendor Partners.

By using OrderWayz, you agree to these Terms and confirm you have the legal capacity to enter into binding agreements.

Key Terms:

  • OrderWayz Platform: The web-based system enabling ordering, payment processing, marketing, and related services.
  • User: Any person or entity placing orders through our vendor's web application.
  • Vendor Partner: Food establishments and businesses offering products via OrderWayz.
  • 3rd Party Delivery Service: Independent delivery providers integrated with the Platform.
  • Products: Food, beverages, and related items sold by Vendor Partners.
  • Account: User profile within the Platform for accessing enhanced features.

2. User Accounts and Access

You may use OrderWayz with or without creating an Account. Registered Accounts provide access to order history and saved preferences.

You are responsible for maintaining the security of your login credentials and all activities under your Account.

OrderWayz may suspend or terminate Accounts for Terms violations, providing 14 days' written notice except in cases of serious breach.

3. Platform Functionality

OrderWayz serves as a technology platform connecting Users with Vendor Partners. The Platform enables:

  • Viewing menus from Vendor Partners
  • Placing and managing orders
  • Facilitating payment transactions
  • Marketing and promotional communications

OrderWayz is not the seller of Products. All purchase contracts are formed directly between Users and Vendor Partners.

Vendor Partners have sole responsibility for menu accuracy, product preparation, food safety, refunds, complaints, consumer rights, and regulatory compliance.

4. Placing Orders

When you submit an order, a binding contract is formed upon acceptance by the Vendor Partner.

Product listings are invitations to treat. Vendor Partners may decline orders at their discretion.

Due to the perishable nature of food items, standard withdrawal rights may not apply once preparation begins.

5. Vendor Partner Obligations

Vendor Partners are responsible for:

  • Accuracy of pricing, product descriptions, and allergen information
  • Product availability and menu updates
  • Food safety and quality standards
  • Processing refunds and handling complaints
  • Compliance with applicable laws and regulations

6. Payments

Prices displayed include VAT where applicable. Additional fees for delivery, packaging, or small orders may apply.

Vendor Partners connect their own payment methods directly. OrderWayz facilitates payment processing but does not handle refunds; all refund requests must be directed to the Vendor Partner.

  • Online card payments

7. Delivery Options

OrderWayz supports multiple fulfilment methods:

  • Local delivery (orders can be fulfilled by vendor's in-house delivery riders or 3rd party riders)
  • Takeaway (Pick-up) collection

8. 3rd Party Delivery Service

Delivery services may be fulfilled through Stuart 3rd Party Delivery Service, an independent logistics provider integrated with the Platform.

OrderWayz is not a party to delivery contracts. We are not liable for courier performance, delivery delays, lost items, or damage during transit.

9. Intellectual Property

All Platform content, functionality, and technology are protected by intellectual property laws and owned by OrderWayz or licensed from third parties.

10. User Obligations

You must use the Platform lawfully and responsibly. Prohibited activities include fraud, abuse, unauthorized access, or violation of applicable laws.

Violation of these obligations may result in account suspension or legal action.

11. Data Privacy

Personal data is processed in accordance with UK GDPR, applicable data protection laws, and the OrderWayz Privacy Policy.

12. Modifications to Terms

OrderWayz may modify these Terms at any time. Material changes will be communicated to Users at least 14 days in advance.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales.
